No improper conduct, obscenities, intimidation, verbal or physical threats by Owners, their residents, tenants, family, guests, service personnel, vendors, contractors and any other invitees (hereafter “invitees”) will be tolerated, whether made directly or implied by words or actions. Actions by any person of any nature, at any time, both in the common areas and individual lots, which may be dangerous, threatening, or create a hostile environment, are not permitted. These include, but are not limited to: (1) excessive noise, rowdy behavior or intoxication, (2) quarreling/fights, (3) harassment, (4) threats, and/or (5) offensive or abusive language.
Owners are responsible at all times for the reasonable conduct of their residents, tenants and/or invitees.
All owners, their residents, tenants and/or invitees are presumed to conduct themselves with due consideration for each other, the Community Management, the Board of Directors, Association Vendors, Volunteers, Committee Members, Community Members, Owners and their residents, tenants, family, guests, service personnel, vendors, contractors, invitees, and any employees of the Association, (hereafter “staff”). The Board of Directors has the authority to discipline any applicable Owner for their conduct or their residents’, tenants’ and/or invitees’ conduct, which in its opinion may endanger the welfare, interest or character of the Association and/or its staff and/or Community Members as well as for violations of the governing documents of the Association, including the Association’s rules and regulations.
While Owners and residents are certainly free to express their disagreement with Association decisions and/or policies, management, staff members, and Board of Directors, are to be treated in a civil, courteous, and considerate manner at all times. No staff member shall be reprimanded, threatened, or harassed in any way by an Owner, his/her residents, tenants and/or invitees. All complaints regarding service rendered by any staff member must be made to the Board of Directors and/or General Manager for appropriate handling (see below).
All persons attending any Association meeting or function must comply with any parliamentary procedures and/or rules for conducting the meeting or function. Persons failing or refusing to do so will be required to leave the meeting or function in addition to being subject to the disciplinary actions described below.
Should persons causing or participating in inappropriate behavior refuse to cease and desist their activities, the person in charge of the facility at the time (i.e., Association Management, Board Member, or Board-authorized acting person) may seek the assistance of local law enforcement agency to maintain order.
The Association considers a violation of any of the foregoing rules a serious violation which will subject the applicable Owner to disciplinary action pursuant to Civil Code section 5855 and the Association’s disciplinary procedures.
